Brain injuries can have long-term health consequences

The list of potential injuries that car accidents in Ontario could cause is endless. Some victims recover soon while the lives of others will never be the same. Brain injuries are unpredictable, and their consequences are unique for each car accident victim. As the financial consequences could be significant, it's generally wise to gain clarity about how the brain injuries will affect the car accident victim in the future before agreement to a settlement for personal injuries.

In some cases, brain injury symptoms that continue for longer than three months might require specialist care. The severity and nature of the damage to the brain will determine the type of care to seek. It could be a psychologist, sleep specialist, neuropsychologist or a psychiatrist. Some victims might need to see a  neuro-opthalmologist, physiotherapist, optometrist, or a brain injury specialist. Rehabilitation and treatment for chronic pain and headaches may be required.

Waiting lists at treatment facilities could be long, and costs of treatment in private clinics are typically high. Dealing with insurance systems could be confusing without the support and guidance of an experienced personal injury lawyer. Choosing legal counsel with experience in dealing with catastrophic injuries is the best way to go whether that may be through insurance claims or litigation.

An experienced Ontario lawyer can assess the circumstances and the need for ongoing medical care and rehabilitation. If the brain injuries prevent the client from returning to work, lost income will be included as part of the documented claims. The statute of limitations on most personal injury claims in Ontario is two years, in part to allow brain injury victims enough time to understand how the injuries will affect their lives going forward and pursue comprehensive damage recovery.
