Thousands of Ontario residents suffer head injuries every year. Any knock to the head can cause brain injuries, and in many incidents, the negligence of other parties caused the injuries. While automobile accidents and workplace accidents are the most frequent causes of traumatic brain injury, incidents such as assault can also cause it.
One such case recently occurred at a high school when an altercation took place between three students. Paramedics arrived to transport one student to a local hospital for treatment of head injuries. The severity of the injuries is not known, and it is not clear whether he suffered brain trauma. However, he was later transferred to the McMaster University Medical Centre in Hamilton. Police arrested the two other students involved, and they are now facing charges of aggravated assault.
The parents of the injured student may have many questions about their legal rights. Medical bills for current, and possible future treatment will likely be a concern. They might also wonder about where and with whom responsibility lies for the incident, and whether they can pursue claims for recovery of the damages.
Ontario residents do not have to face these questions alone. An experienced personal injury lawyer can provide guidance and support in making decisions about time-critical issues. The lawyer can assess the circumstances of the incident in which the child suffered brain injuries, and determine whether the school – or any staff members — might also bear responsibility for lack of supervision and failure to keep students safe.
